This website, www.noesyssoftware.com, and its associated domains including www.infoveave.com, (the "Website") is owned and operated by Noesys Software Private Limited (the "Company"/ "Noesys"), having its registered office at #564, 1st Floor, "Srigandha Arcade", 9th Cross, J.P. Nagar 3rd Phase, Bengaluru, Karnataka, 560078, India.


This privacy policy describes the manner in which the Company and its affiliates collect, process, store, share, retain and purge your personal information and/or data that we receive from you when you visit and/or use our Website to access our services (the "Services") or which we otherwise collect from you to provide our services. (the "Privacy Policy").


Protecting your personal information is our priority and usage of such information shall be in accordance with this Privacy Policy and applicable laws governing data protection and privacy in India.

For the purposes of this Privacy Policy, the following terms shall have the meaning as provided under this section:

  • "Device" means any device that can access the Service such as a computer, a cell phone or a digital tablet.

  • "Personal Data" means any data or information that relates to an identified or identifiable natural person.

  • "Product" refers to Infoveave (www.infoveave.com) our Unified Data Automation and Decision Intelligence platform and its components.

  • "Service Provider" means anyone who processes the data on behalf of the Company. It can refer to third-party companies or individuals employed by the Company to facilitate the Product/service.

  • "Usage Data" refers to data collected automatically, either generated using the Website or the Service or from the Service infrastructure itself, including interaction with the chatbot on the Website.

  • "You" or "you" shall mean the individual accessing or using the Service, or the legal entity on behalf of which such authorised individual is accessing or using the Service, as applicable.

Applicability


  1. This Privacy Policy describes the manner in which the Company collects, processes, stores, shares and retains your Personal Data.

  2. This Privacy Policy is limited in its applicability only to your use of the Website. It does not apply to any Personal Data, so collected by any third parties by virtue of you clicking any third party links on our Website out of your free volition (the "3rd Party Website"). In such an event, the Privacy Policy of such 3rd Party Website shall be applicable to You.

  1. By accepting the Terms and Privacy Policy, you hereby provide your express consent to the Company to collect, process, store, share, retain and purge the Personal Data submitted by you in accordance with the applicable law, as amended from time to time.

  2. Your bank account details, billing name and address, Tax number (GST, TAN, PAN), payment mode (the "Payment Information"), and that of the representative who signs up for a Service on your behalf;

  3. Usage Data, including language preferences;

  4. Computer and internet connection including your IP address, operating system and browser type;

  5. Mobile carrier and device information including device and application IDs; How you behave on the Website, (what pages you land on, how much time you spend, etc.);

  6. How you behave in the relevant Product environment and use the features;

  7. When you authorize us to post testimonials about our products and services on websites, or choose to partner with us, we may include your name and other personal information in the testimonial. You are hereby strictly advised not to provide your Personal Data while interacting with our chatbot if it exists on the Website. Where any such instance is discovered, the Company reserves the right to immediately delete such information from its servers and shall in no manner whatsoever be held liable for such actions thereof.


We shall be entitled to withdraw our Services immediately upon discovery of your Personal Data to be incorrect, incomplete and/or inaccurate without any notice and/or at the discretion of the Company, without limitation to initiating any legal action against you for seeking any legal relief and/or remedy.


The Company shall take all reasonable measures as prescribed under law to prevent unauthorized access and misuse of your Personal Data. However, the Company shall not be responsible for any such unauthorized access and misuse of your Personal Data by unauthorized persons despite having taken all such measures prescribed under the applicable laws. Any personal data processed in our systems is handled in compliance with applicable data protection laws, including GDPR and CCPA where relevant.

  1. We shall not use your Personal Data for any purpose other than in furtherance to providing the Services.

Data Retention and Storage


  1. We may store any personal data we collect from you as long as it is necessary in order to facilitate your use of the Services and for ancillary legitimate and essential business purposes these include, without limitation, for improving our Services, attending to technical issues, and dealing with disputes.

  2. We may store your data on servers provided by any third-party hosting vendor whom we have a valid contract with.

  3. We shall retain your Personal Data on our servers for such period as may be prescribed by law from time to time.

If you are a customer, please be advised that: (i) you will need to inform your customers about how you store and deal with any data you collect from them using our Services, in compliance with applicable laws including the GDPR; and (ii) after you terminate your usage of a Service, we may, unless legally prohibited, delete all data provided or collected by you from our servers.

  7. If you are a Customer, you are empowered to use proprietary or other third party technologies and integrate with our Services. If you do, you agree and acknowledge that it is your sole obligation to inform your stakeholders about any data you collect by using such technologies and the policies by which such collection is bound.

Data Purging


  1. The Company has necessary policies, mechanisms and tools in place to ensure that all your Personal Data so collected and stored is deleted as soon as the purpose, as described in this Policy is completed, unless it is mandated by law to be maintained by the Company.

  2. Any data destroyed shall be disposed of in a manner that protects the confidentiality of your Personal Data, in an appropriate manner as per the standards prescribed under applicable laws.

Data Security


  1. The Company shall take all reasonable measures to prevent unauthorized access, use and disclosure of your Personal Data.

  1. In furtherance to keeping your Personal Data safe and secure, the Company may collect the following information:


    1. Anonymous data from every visitor of the Website to monitor traffic and fix bugs which includes (without limitation) information like web requests, the data sent in response to such requests, the Internet Protocol ("IP") address, the browser type, the browser language, unique identifiers of the device through which the application is accessed, such as VPN, information of Wi-Fi connectivity and a timestamp for the request; and

    2. Log file information is automatically reported by your browser each time the application is viewed. The server supporting the application logs may include information such as web request, IP address, analytical code, geo stamp, browser type, browser language, referring/exit pages and Universal Resource Locators ("URL"), platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on a particular page, the date and time of the request ("Log File Information"). Such Log File Information collected is not associated with any Personal Information and is only tagged to the unique identifier for a particular device.

Data Transfer


  1. Unless expressly permitted under law or by express consent by you, the Company shall not transfer your Personal Data to any third party, within and/or outside the territorial jurisdiction of India. Notwithstanding the foregoing, the Company may need to transfer your Personal Data outside of India to facilitate the provision of our Services or for Disaster Recovery purpose. Your rights and protections will, under no circumstances, be diluted by this transfer. By providing your consent at the time of signing up for our Services, you expressly agree to such transfers.

  2. Further, in the ordinary course of business, we may employ other companies and people to assist us in providing certain components of our Services in compliance with the provisions of this Policy. To do so, we may need to share your data with them.

  3. Where applicable if the entities to which these transfers are affected are not situated in countries deemed 'adequate' by the European Commission, we shall enter into appropriate Data Protection Addendums with the transferee parties that comprehensively protect your data.     6. The right to Object processing your Personal Data - You have a right, at any time, to object to our processing of your personal data under certain circumstances. You have an absolute right to object to us processing your personal data for the purposes of direct marketing.

    7. Right to data portability - You have a right to request us to provide you with a copy of your personal data in electronic format and you can transmit that personal data for using another third-party's product/service.

    8. Right not to be a subject to automated decision making - You have a right to not be subject to a decision based solely on automated decision making, including profiling.

    9. The right to nominate another individual to exercise your rights with respect to your Personal Data that is collected by the Company.

  2. You may exercise these rights by expressly writing to our Grievance Officer as described below.

    1. If you are a Customer/User using our Services to collect data about an EU data subject from third parties, it shall be your sole obligation to inform such data subject about the source of such data; and

    2. The Company does not collect any Special Categories of Personal Data. Further, if you are a Customer/User, you hereby agree and acknowledge that you shall not, under any circumstances, whether directly or indirectly, use our Services to collect or process Special Categories of Personal Data or transfer to us any such data.

    3. The term "Special Categories of Personal Data" shall have the meaning ascribed to it under the GDPR and shall include, without limitation, data pertaining to a data subject's race, ethnic origin, genetics, political affiliations, biometrics, health or sexual orientation.

  4. Your rights under California Consumer Privacy Act (CCPA) - The Company complies with CCPA by giving you the five privacy rights for California consumers:


    1. The right to know about the personal information a business collects about them and how it is used and shared. You have a right to be informed about the manner in which any of your personal data is collected or used which the Company has endeavoured to do by way of this Policy.

    2. The right to delete personal information collected from them.

    3. The Company gives you the right to request us to delete your personal data.

    4. The right to opt-out of the sale of their personal information.

    5. The right to non-discrimination for exercising their CCPA rights.

    The Company does not sell any data of any of its users/customers/leads. The Company assures no discrimination against consumers exercising their right of privacy under CCPA.

Compelled Disclosure


  1. In addition to the purposes set out in the Policy, we may disclose any data we collected or processed from you if it is required

    2. To protect our safety, your safety or the safety of others or in the legitimate interest of any party in the context of national security, law enforcement, litigation, criminal investigation or to prevent death or imminent bodily harm;

    3. If required in connection with legal proceedings brought against the Company, its officers, employees, affiliates, customers or vendors; or

    4. To establish, exercise, protect, defend and enforce our legal rights.

Public Data


  1. Any information that is freely available or accessible in the public domain or furnished under any law for the time being in force shall not be regarded as Personal Data.

  2. We shall not be responsible in any manner of whatsoever nature for any unauthorized use, violation or misuse of such publicly available information.

Children and Disabled Persons


  1. Our Services are not intended for children. If You are under the age of eighteen (18) years and/or a disabled person, you shall be entitled to submit your Personal Data while using the Website only with the expressed consent of your parent or guardian, as the case may be.

Dispute Resolution & Governing Law


  1. Any dispute or grievance remaining unresolved for a period of over 30 (thirty) business days, post exhausting grievance redressal mechanism, may be resolved by referring such disputes to the Data Protection Board (the “DPB”) as may be notified by the Government of India in this regard.

  2. This Privacy Policy shall be governed by the laws governing data protection and privacy laws within the jurisdiction of India.

Changes to This Privacy Policy


  1. The Company reserves the right to change this Privacy Policy from time to time as may be required under any law.
